Kabool-Hai is a service that offers you a choice and a safe and efficient place to meet the ideal partner or make new friends and share your hobbies or passions with them. Profiles posted for any other purpose, e.g. advertising, sexually explicit or discriminatory material, will be refused. Moreover, no profile from minors, professionals or couples, or profiles containing ‘suggestive’ photographs or pictures of celebrities, or profiles otherwise contrary to the spirit of this website will be accepted.

We make every effort to ensure that our members and visitors will enjoy their visit to this website. Thus we would like you to become familiar with your rights and obligations. We urge you to read the General Terms and Conditions described below carefully to help you understand the operation of Kabool-Hai and the rules to follow.

Article 1 - Acceptance of General Terms and Conditions - Top of page

1.1 To register on this website and subscribe to the dating service offered by Kabool-Hai (hereinafter the “Service”) on www.Kabool-Hai.ca or any of its partner websites (hereinafter the “Kabool-Hai Website”), you must necessarily agree to the General Terms and Conditions (hereinafter the “General Terms and Conditions”) set forth in this document. Anyone who subscribes to the Service becomes a member of Kabool-Hai (hereinafter the “Member”).

1.2 The General Terms and Conditions may be amended from time to time and at any time. These General Terms and Conditions were amended and updated on July 1, 2007. Any subsequent amendment which affects current subscriptions shall be announced as follows: each Member shall receive an e-mail informing such Member of the changes made to the Service in the month before such amendment comes into force. Each Member shall then be entitled either (i) to accept the new terms and conditions or (ii) cancel his or her subscription to the Service without cost within four months following the date on which such amendment comes into force. If no cancellation is made within such time, the Member shall be deemed to have accepted such amendment.


Article 2 – Undertaking of the Users - Top of page

2.1 Kabool-Hai requires every Member to undertake not to use the Service to:

  • provide false information about such Member in his or her profile;
  • harm anyone in any way whatsoever, and more particularly a minor;
  • publish any material which could incite someone to commit a crime or other offence or provoke discrimination, hatred or violence based on race, ethnic origin or nationality or provide false information;
  • publish private and personal information regarding adoption, ongoing trials or the suicide of a minor, or information regarding a person’s tax status or information violating anyone's privacy;
  • slander or abuse anyone via the website or a profile;
  • undermine the authority of the justice system or endanger minors, namely by producing, conveying and publishing material of a violent, pornographic or degrading nature;
  • attempt to mislead other users by using someone else’s name, identity, photograph or corporate name;
  • post or send any material infringing a patent, trade-mark, trade secret, intellectual property right or other proprietary right of another person;
  • post or send unsolicited or unauthorized advertising or promotional material (namely by spamming or any other form of solicitation) or harass one or more users in any way whatsoever;
  • collect and store personal data on other users;
  • intentionally or unintentionally contravene any national or international law or regulations.
2.2 Kabool-Hai considers the above obligations as conditions precedent and, in the event of non-compliance therewith or breach thereof, Kabool-Hai shall have the right to (i) delete or withdraw any material deemed in breach of the terms and conditions hereof or otherwise deemed reprehensible; (ii) cancel all or part of the access corresponding to your account and your password at any time, effective immediately, and/or prohibit subsequent access to the Service.


Article 3 – Your registration as a Member - Top of page

3.1 Profiles are limited to one per user on Kabool-Hai and its partner websites. Registration is free and you register by posting your profile and confirming your registration by e-mail. Your registration becomes final only upon being validated by our monitoring team.

4.1 Purchasing Policy and Subscription Terms and Conditions

All purchases are final. Before purchasing a subscription, verify your choice of subscription carefully. No refunds or exchanges shall be allowed once a subscription has been purchased, even if our services are not used or a computer failure occurs during your subscription period.

To ensure that our Members benefit from continuous service, subscriptions paid for by Paypal shall automatically be renewed upon expiry.

Expiry of the subscription. The expiry of your subscription does not entail the automatic deletion of your profile as you may remain a Guest Member. To delete your profile permanently, please contact us with the account information.

NB.: deleting your profile is permanent and results in the deletion of your profile, photographs and messages. To access Kabool-Hai again, you will be required to register anew and create a new profile.

Article 5 - Security and Control by Kabool-Hai - Top of page

5.1 Protection of Minors. Kabool-Hai endeavours to respect the safety and privacy of the users of its website, and more particularly children. Minors are not allowed on the Kabool-Hai Website. Parents are urged to monitor their children’s use of Kabool-Hai, keeping in mind that the Kabool-Hai Website is designed to reach a wide audience. As legal guardians, parents have the responsibility to decide whether or not the website is appropriate for their children and to monitor their children’s use thereof. Your presence on the website implies that you are of legal age, mentally competent and/or are considered to have the legal capacity to use the website.

5.2 We ask you to be on your guard to protect the security of your own password. Your password enables you to gain access to the website for personal use only. Do not make your password easily accessible and avoid disclosing it to third parties.

5.3 It is strictly forbidden to use or communicate the tools at your disposal with a view to cause harm to the security of the website, to manipulate the resources of the system or the right of access to the Internet, to attempt to discover passwords or to hack into or spy on the network.

5.4 Members and visitors of Kabool-Hai may be required, upon request, to play an active role in the prevention of computer hacking. If you are personally involved in any such breach of the security system, Kabool-Hai may be required to provide the relevant details and circumstances to the authorities and assist them in their investigation and in resolving the problem.

5.5 Kabool-Hai monitors some Member activities on Kabool-Hai. For this purpose, Kabool-Hai has a team of monitors assisted by software programs that automatically detect inappropriate use (mass sending of e-mails, soliciting, exchanges relating to minors and any statements or use which are non-compliant with the undertakings set forth in section 2 above). Kabool-Hai provides this monitoring service on its own initiative or as a result of a complaint or comment by another Member.

Article 7 - Proprietary Rights - Top of page

7.1 This website is the property of Kabool-Hai. The graphic design and all the content thereof, whether owned by Kabool-Hai or by third parties, are protected by trade-marks and copyright and any unauthorized use thereof constitutes an infringement punishable by law.

7.2 On becoming a Member, you agree to grant Kabool-Hai a licence to use the information in your profile to provide and promote the Service. Such licence relates to the reproduction, representation, translation and distribution on any medium (press, radio, television, e-mail, Internet) of the content and elements of your profile (information, text, and photo). Such licence is restricted to the term of your registration on the Kabool-Hai Website and to the jurisdictions in which Kabool-Hai operates. Furthermore, you agree that such licence may be transferred to any successor or assign of Kabool-Hai.

7.3 You are authorized to access and use the website and all the content thereof on a simple computer for your own private and non-commercial use only. Moreover, using all or part of this website on another website, a computer network or any other medium is prohibited. It is further strictly prohibited to unlock, reverse engineer, decompile, copy and/or read the code used by the website software for the purpose of examining or copying the same or creating derivatives based in whole or in part on the software used by the website, except to the extent permitted by law. No part of the website may be reproduced, published, copied, recorded, mailed, transmitted, broadcast or distributed in any way whatsoever without the prior express authorization of Kabool-Hai, except as permitted by law.

Each Member or visitor is responsible for his or her own actions and dealings with other Members or visitors on the website. Each Member is responsible for the content, information, services or any other element which he or she decides to bring to the attention of the other Members or visitors on the website. Such information is distributed “as is”, without any express or implied warranty of any kind, particularly as regards the accuracy and veracity of the facts or of any content on the website.


Article 9 - Responsibility of Kabool-Hai - Top of page

9.1 Every possible effort is being made by Kabool-Hai to monitor the messages exchanged between Members. Kabool-Hai reserves the right to delete or modify at any time any content which it deems inappropriate (including Member profiles) after notifying the relevant Member (except where a fundamental obligation is breached, in which case prior notice is not required, see section 2.2). In the event of inappropriate content appearing on the website which has escaped Kabool-Hai’s notice, Kabool-Hai requests you to notify it thereof.

9.2 Despite the procedures described above and owing to the volume of information between Members, control of the content sent by Members over the Service cannot but be limited, and thus Kabool-Hai cannot guarantee the veracity or honesty of such content.

9.3 Kabool-Hai shall use its best efforts to ensure that the Service is available at all times, without interruption or error and to ensure that the website or the servers that enable the operation of the website online are virus-free and without dysfunction. The Service may be momentarily interrupted for maintenance operations designed to improve or correct the Service, in which case Kabool-Hai shall use its best efforts to inform the Members thereof beforehand and to reduce the inconvenience resulting from such interruption.


Article 10 - Warning - Top of page

10.1 Kabool-Hai strongly advises never to disclose personal information to other Members, such as your real name, postal or e-mail address, telephone number, which could allow you to be identified offsite. Where such information appears in your personal profile or vocal messages, Kabool-Hai reserves the right to delete it without prior warning. In case of a second offence, access to the website could be denied without warning.

10.2 Kabool-Hai advises its Members to take every possible precaution when meeting other people for the first time. For example, it is recommended to meet in a public place (a bar, restaurant etc.). We further recommend that you notify a close friend if you decide to meet in a private place.
